With new technologies come new employment law issues.
Here’s an interesting article from the New York Law Journal that talks about just a few potential ramifications of social networking on legal issues.
Most interesting to me is the article’s discussion of two cases in which plaintiffs relied in part on social-media-related-actions to establish retaliation and/or harassment and discrimination.
Moreover, the article points out that an employer’s or employee’s posts can implicate not only harassment and discrimination laws but also other areas, such as defamation or privacy law.
The article’s recommendation that an employer establish guidelines about use of social media seems a sound one to me.
